1. Introduction
Welcome to Reklaim Protect (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your subscription to our data protection and monitoring service (“Service”), offered via our platform ("Platform"). By subscribing, you (“you,” “your,” “User”) agree to be bound by these Terms. If you disagree, please do not subscribe to or use the Service.
2. Service Overview
Reklaim Protect provides identity and data protection services, including monitoring, alerts, and removal assistance, by acting on your behalf to mitigate the misuse or exposure of your personal information.
3. Subscription Fee, Billing & Renewal
Pricing: The Service is offered on a monthly subscription basis with the option of a discounted annual plan.
Billing: Subscriptions renew automatically at the end of each billing period. Your payment method will be charged unless you cancel before the renewal.
Price Changes: We reserve the right to update subscription rates or terms. Continuing use after notification constitutes acceptance.
4. 30-Day Money-Back Guarantee
You may cancel within 30 days of your initial purchase for a full refund, provided you are eligible and this is your first cancellation.
To request a refund, contact our Customer Support within the guarantee period.
After 30 days, no refund is available unless exceptional circumstances arise (e.g., service unavailability), at our sole discretion.
5. Cancellation & Account Termination
You may cancel at any time. Cancellation takes effect at the end of the current billing cycle. Termination for violating these Terms voids eligibility for refunds.
6. Automatic Renewal
By subscribing, you authorize us to charge your payment method automatically at the end of each billing period unless you cancel beforehand.
7. Disclaimers; “As Is” Basis
The Service is provided “as is” and “as available,” without warranties of any kind—express or implied, including fitness for a particular purpose or non-infringement.
8. Limitations of Liability & Indemnification
Limitation of Liability: We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
Indemnification: You agree to indemnify and hold us harmless against claims, damages, liabilities, and costs resulting from your use of the Service or violation of these Terms.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario without regard to conflict of laws principles.
Disputes will be resolved through binding arbitration under applicable arbitration rules, and you waive the right to participate in class actions.
10. Privacy and Data Use
We collect and process your personal data as described in our Privacy Policy, which is incorporated here by reference. If there’s any conflict between this Agreement and our Privacy Policy, the Privacy Policy prevails.
11. Changes to Terms
We reserve the right to amend these Terms at any time. We will notify you of changes (e.g., via email or Platform notice). Continued use after modifications constitutes acceptance.
